Hub234 Customer Terms and Conditions

1. Introduction
Welcome to Hub234! By using our platform, you agree to these Terms and Conditions. Hub234 is a marketplace that connects customers with independent vendors. Hub234 is not the seller of the products listed by vendors.

2. Acceptance of Terms
By creating an account or placing an order (including as a guest), you agree to be bound by these Terms. If you do not agree, please do not use the platform.

3. Account Registration
You may create an account to track orders and manage preferences. You are responsible for maintaining the confidentiality of your login credentials. Guest checkout is also available, and all guest users are deemed to have accepted these Terms upon placing an order.

4. Product Listings and Accuracy
Product descriptions and images are provided by vendors. Hub234 does not guarantee the accuracy, completeness, or reliability of vendor-provided content.

5. Fulfillment Options
Hub234 offers two fulfillment models:

UK Fulfillment: Products are stored and shipped from Hub234’s UK warehouse.
Nigeria Fulfillment (Pre-Order Model): Products are stored in Nigeria and shipped to Hub234’s Nigerian warehouse for collation and international dispatch on scheduled shipping dates.

6. Nigeria Fulfillment Terms

Orders fulfilled from Nigeria are non-cancellable once placed.
Delivery timelines are longer and based on scheduled shipping dates.
Customers agree to the vendor’s return policy, which may differ from UK-based returns.
Hub234 is not liable for delays, customs issues, or damages arising from vendor-side errors or third-party logistics during Nigeria-based fulfillment.

7. Returns and Refunds
Each vendor sets their own return policy. Customers must contact the vendor directly for returns. Hub234 may assist in resolving disputes but is not responsible for enforcing vendor return policies.

8. Pricing and Shipping Fees
All prices are in GBP. Shipping fees may vary depending on the fulfillment model and destination. Hub234 reserves the right to increase or decrease shipping fees at its discretion, with changes reflected at checkout.

9. Payment
Payments are processed securely via third-party providers. Hub234 is not liable for payment processing errors or delays.

10. Shipping Insurance Disclaimer
Unless explicitly stated at checkout, Hub234 does not provide shipping insurance. Customers may opt-in for insurance where available. Hub234 is not responsible for loss or damage during transit unless insurance has been purchased.

11. Limitation of Liability
To the fullest extent permitted by law, Hub234 disclaims all liability for:

Vendor errors, delays, or product defects
Losses arising from third-party shipping or customs delays
Indirect or consequential damages

12. Force Majeure
Hub234 shall not be held liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, or disruptions in transportation or communication systems.

13. Intellectual Property
All content on the Hub234 platform is protected. You may not reproduce or use any content without permission.

14. Confidentiality
You agree not to disclose, reproduce, or use any confidential information you may gain access to through your use of Hub234’s platform, including but not limited to vendor pricing, logistics processes, or proprietary technology, except as required to complete a transaction. Hub234 also agrees to protect your personal data in accordance with its Privacy Policy and applicable data protection laws.

15. Data Protection and Privacy
Hub234 is committed to protecting your personal data. We collect, store, and process your information in accordance with applicable data protection laws, including the Nigeria Data Protection Act (NDPA) and the UK General Data Protection Regulation (UK GDPR), where applicable. Your data will only be used for the purpose of fulfilling your orders, improving our services, and communicating with you. We do not sell or share your personal information with third parties without your consent, except as required by law or necessary to complete your transaction. 16. Dispute Resolution
Disputes should first be addressed with the vendor. If unresolved, Hub234 may mediate but does not guarantee resolution.

17. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria.

18. Jurisdiction for International Buyers
Regardless of your location, you agree that any disputes arising from your use of Hub234 shall be subject to the exclusive jurisdiction of the courts of the Federal Republic of Nigeria.

19. Changes to Terms
Hub234 may update these Terms at any time. Continued use of the platform constitutes acceptance of the revised Terms.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.

21. Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
